Chris practises as a lawyer and barrister in both Australia and formerly the United Arab Emirates. Chris has been a construction, property and commercial lawyer since 1998. He has worked on grand scale and iconic projects and represented government and private developers and contractors in some of the largest arbitrations in the world at ICSID, LCIA, ICC, DIAC and DIFC-LCIA.  Chris is a trained advocate having spent three years practising as a Barrister and can appear for clients in all courts and tribunals.

Successful Adverse Possession Application

Urban Lawyers recently acted for a developer in relation to an application for adverse possession of a strip of land adjacent to the developer’s property in Caulfield South. The adverse possession application was upheld by the Land Registry and a new title has been issued to the developer with respect to the adversely possessed land. As a result, the developer’s property has significantly increased in size as it now includes the adversely possessed land. This has resulted in a significant improvement in the property’s development potential and a substantial increase in its sale price.

Council’s refusal to grant extension to planning permit overturned by VCAT

Frequently Urban Lawyers assist developers to overcome objections from council and road blocks so they can proceed with their project. In this case, a developer of a multi-rise development consisting of apartments and a retail component was refused an extension of time to the planning permit by the responsible authority. Urban Lawyers commenced a planning appeal to VCAT, which overturned the decision of the responsible authority and the project was granted approval to realise its full potential.

Significant payment victories under the Building and Construction Industry Security of Payment Act and Corporations Act

Urban Lawyers recently pursued an adjudication application on behalf of a subcontractor in relation to a payment claim that a contractor was refusing to pay. The adjudication application was completely successful as the contractor made payment of the payment claim in full prior to the adjudicator issuing his determination.

Urban Lawyers successfully recovered a debt on behalf of a contractor after giving the debtor company notice that it would be serving a statutory demand under the Corporations Act.

Design and Construct Contract and Commercial Agreements

Urban Lawyers has prepared a design and construct contract based on AS 4300 1995 with substantial amendments on behalf of a developer with respect to the development of 29 apartments and will provide ongoing legal advice to the client during the project. Urban Lawyers has also prepared other complex commercial agreements for its clients including joint venture agreements, put and call option agreements, project management agreements, consultancy agreements, leasing agreements and contracts of sale incorporating special conditions for off the plan sales.
